Terms of Service
These Terms of Service govern your access to and use of AdvancedMind AI. By creating an account or using the service, you agree to them. Read them together with the Acceptable Use Policy, the Research Mode Policy, and the Privacy Notice, which are incorporated by reference.
Last updated: June 23, 2026
1. Definitions
“Service” means the AdvancedMind AI platform, including the web application, the API, and related documentation. “We,” “us,” and “AdvancedMind AI” mean the operator of the Service. “You” means the person or entity using the Service. “Organization” means the billing account that holds your credit balance and to which one or more users may belong. “Credits” means the prepaid USD balance used to meter inference. “Provider” means a third party that hosts or serves a model we route requests to.
2. Accounts
You must provide accurate account information and keep it current. You are responsible for all activity under your account and for safeguarding your credentials and API keys. Each account belongs to an Organization; permissions, credit balance, and Research Mode access are managed at the Organization level. You must be of legal age to form a binding contract in your jurisdiction and must not be barred from using the Service under applicable law or sanctions. You are responsible for the acts and omissions of users you add to your Organization.
Notify us promptly if you believe a credential has been compromised. We may suspend an account or revoke a key where we reasonably believe it is necessary to protect the Service, other customers, or to comply with law.
3. Prepaid credits and billing
The Service is metered and prepaid. There is no free inference tier. A positive credit balance is required before any inference request reaches a Provider; a request that your balance cannot cover is blocked before any Provider call is made, and no tokens are billed for it.
- Per-request cost. Each request debits Credits by its exact cost, computed from the input and output tokens consumed at the published per-million rates for the model used. See Pricing & credits for the calculation and the published rates on the models page.
- Included credits. Paid plans grant a monthly credit allotment that lands on your billing date. Included credits do not roll over and are forfeited if unused at the end of the billing period.
- Top-ups. Purchased credits are charged at the time of purchase, are available immediately, and do not expire. Included credits are consumed before purchased credits.
- No refunds on consumed credits. Credits that have been spent on completed requests are non-refundable. Except where required by law, fees and top-ups are non-refundable, and unused purchased credits are non-refundable upon termination.
- Taxes. Stated prices exclude taxes. You are responsible for any sales, use, value-added, or similar taxes, excluding taxes on our net income.
- Price changes. Published per-million model rates and plan terms may change. Changes apply prospectively to requests made and credits purchased after the change takes effect.
You authorize us, or our payment processor, to charge your payment method for plan fees and top-ups you initiate. Disputed charges should be raised with us before initiating a chargeback.
4. Acceptable use
Your use of the Service is subject to the Acceptable Use Policy, which forms part of these Terms. You must use the Service only for lawful purposes and, where approval applies, within your approved scope. You must not use the Service to cause harm, to facilitate unlawful activity, or to circumvent its safeguards. Clear abuse is blocked regardless of plan or access tier.
We may investigate suspected violations and may suspend or terminate access, with or without notice, where we reasonably determine that use violates the Acceptable Use Policy or applicable law. We may preserve and disclose information where required by law or to protect the safety of persons or the integrity of the Service.
5. Research Mode access
Research Mode is approval for higher-risk project scopes on our production models. It reduces generic refusals on legitimate technical work and does not authorize conduct prohibited by the Acceptable Use Policy. Approval is granted at our discretion following review, is scoped to an approved project and a named set of models, carries an expiry date, and is revocable. Approved organizations receive first access to gated routes if and when such routes launch; no gated models are offered today.
- Approval does not waive metering. Requests made under an approved scope bill against your credit balance at published rates like any other request.
- Approval is bound to the project scope and the named models in your entitlement. Use outside that scope is outside the grant.
- We may suspend, narrow, or revoke Research Mode access at any time, including where an entitlement expires, where the project scope changes, where access is misused, or where high-risk access is under review. Suspension or revocation of Research Mode access does not affect your standard access or your credit balance.
The full terms governing Research Mode are set out in the Research Mode Policy.
6. API keys and security
API keys authenticate requests against your Organization and spend your Credits. Treat keys as secrets: do not embed them in client-side code, public repositories, or shared environments. You may set per-key spend limits and scopes and may revoke a key at any time. You are responsible for usage and costs incurred through your keys until they are revoked.
7. Service availability and changes
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be unavailable for maintenance, updates, Provider outages, or events beyond our reasonable control. We may add, modify, deprecate, or remove models, features, or endpoints over time; where a change is material we will use reasonable efforts to give advance notice through the documentation or in-product notices. Model availability depends in part on Providers and may change without notice.
8. Intellectual property
We retain all rights in the Service, including its software, documentation, and trademarks. Subject to these Terms, we grant you a non-exclusive, non-transferable right to use the Service during your subscription. As between you and us, you retain your rights in the inputs you submit and, to the extent permitted by the relevant model and Provider, the outputs generated for you. You are responsible for ensuring you have the rights necessary to submit your inputs and to use the outputs for your purposes. You must not copy, resell, reverse engineer, or build a competing service from the Service except as permitted by law.
9. Customer data and privacy
Our handling of account, usage, and billing data is described in the Privacy Notice. We do not use your inputs or outputs to train models; see the No-Training Policy. Routing a request to a Provider necessarily discloses the content of that request to the Provider for the purpose of serving it, subject to the 30-day operational retention that applies to our models.
10. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Model outputs are generated by statistical systems and may be inaccurate, incomplete, or unsuitable for your purpose. You are responsible for evaluating outputs before relying on them, and the Service is not a substitute for professional, legal, medical, or other expert judgment. We do not warrant that the Service will meet your requirements or that defects will be corrected.
11. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Service, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service and these Terms is limited to the amounts you paid us for the Service in the three months preceding the event giving rise to the claim. These limitations apply regardless of the theory of liability and form an essential basis of the bargain. Some jurisdictions do not allow certain limitations, in which case the limitation applies to the fullest extent permitted.
12. Indemnification
You will defend, indemnify, and hold us harmless from third-party claims, damages, and reasonable costs arising from your use of the Service in violation of these Terms or the Acceptable Use Policy, your inputs, or your use of outputs, except to the extent caused by our breach of these Terms.
13. Term, suspension, and termination
These Terms apply for as long as you use the Service. You may stop using the Service and close your account at any time. We may suspend or terminate access for material breach, for non-payment, where required by law, or to protect the Service or its users. On termination, your right to use the Service ends; provisions that by their nature should survive, including billing for amounts due, disclaimers, limitation of liability, and indemnification, survive termination. Consumed credits remain non-refundable on termination as set out in Section 3.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Changes take effect when posted unless stated otherwise; your continued use of the Service after changes take effect constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The state and federal courts located in the State of Delaware have exclusive jurisdiction over disputes arising out of or relating to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information. If any provision is held unenforceable, the remaining provisions remain in effect.
16. General
These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Service and supersede prior agreements on that subject. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. A failure to enforce a provision is not a waiver. Notices to you may be given in-product or to the email on your account.
17. Contact
Questions about these Terms can be directed to our legal contact at [email protected].
